Trustee Stan Springel warned the debtors assets may be "intentionally or
inadvertently lost, destroyed, absconded with, and/or removed," because of an
order by the attorney for the Public Services Commission in the U.S. territory.
Prosser controls the Virgin Islands Telephone Co. and other assets in the U.S.
territory. The reorganization in the U.S. Bankruptcy Court for the Virgin
Islands has lagged, in large part because of fighting between Prosser and his
largest creditors. U.S. Bankruptcy Judge Judith Fitzgerald gave Springel
permission to take charge of Innovative's operations to expedite an auction or
refinancing on Sept. 7.
Springel says PSC counsel Jeffrey Moorhead ordered Innovative not to cooperate
“in any change in control of the Virgin Islands public utilities” on Sept. 11,
allegedly violating the judge’s order. The trustee says his workers have been
denied access to the headquarters, books and financial information of the St.
Croix company. Moorhead could not immediately be reached on Friday. — Chris
