Insights into China's bankruptcy laws

Helena Huang of Kirkland & Ellis LLP provided some key insights into China's bankruptcy law at The Deal/TMA's Distressed Investing Conference 2008 touching on three important provisions in the law that she feels can expand the scale of investment.

Among the issues she pointed out was the lack of precedents in the new laws. "At this point there are no guidelines or detailed implementation rules from the Supreme People's Court of China to give people guidance as to how [certain types of bankruptcy] sale transactions can be done," Huang said.
