Breaking: Court orders review of Whole Foods-Wild Oats merger

072707_wholefoodsSM.pngA federal appeals court Tuesday morning reversed a lower court ruling that allowed Whole Foods Markets Inc. to consummate its acquisition of Wild Oats Market Inc., and it told the court to review the Federal Trade Commission's case to assess what the appropriate next step should be. The result, according to a concurring opinion in the case, could be anything from unwinding the deal or enjoining further integration of the two companies. This move is a shot in the arm for the FTC's merger lawyers, who have not won a litigated merger case in district court for several years. - Cecile Kohrs Lindell
