Dismissal denial gives EnCap room
A New Jersey judge has thrown out an attempt by Wachovia Bank NA to torpedo EnCap Golf Holdings LLC's Chapter 11 case, giving the owner of close to 800 acres of land in the state's Meadowlands a chance to find a developer and reorganize. A hearing on the DIP is set for Sept. 8.- Ben Fidler Wary creditors endanger AMI recap Enough creditors have snubbed American Media Inc.'s recapitalization plan to stave off bankruptcy for observers to worry that a fate akin to the Vertis Inc. printing debacle awaits the Boca Raton, Fla., publisher. The plan, which expires Sept. 25, asks AMI noteholders to swap two tranches of subordinated notes totaling $570 million for a mix of $570 million in notes and convertible securities. - Richard Morgan Carbone creditor objects to cash use A secured creditor of Carbone Cos. has already objected to its use of cash collateral just one day after the contracting and project management company filed for bankruptcy. Fifth Third Bank, owed $15 million for a construction loan issued in 2004, filed its objection Friday.
