Bank Watch: Another failed bank; markets flat

Stocks remained mostly flat Monday morning. The Dow was down 4.78 points at 9,320.23, the S&P 500 was down 2.40 points to 966.35, and the Nasdaq was up 6.06 at 1,727.01. News affecting the markets Monday includes the pending presidential election Tuesday and a drop in manufacturing activity. The Institute for Supply Management reported that manufacturing activity dropped to 38.9, which was a larger drop then expected by many economists, according to CNBC.

Bank stocks remained mostly flat. Bank of America Corp. was sued by Washington on Friday alleging the bank failed to notify the city about fraudulent checks that were part of an embezzlement scheme. There is also news that many Merrill Lynch & Co. brokers could be leaving Bank of America because many are unhappy with the retention bonuses they've been offered.

In other news there was another bank failure this weekend. Freedom Bank of Braderton, Fla., is the latest bank to fail.
