Barr pharma lawyer goes everywhere

| Simpson Thacher's Gary Horowitz |
Gary Horowitz has done deals in two unusual venues for Barr Pharmaceuticals Inc. Last month, the Simpson Thacher & Bartlett LLP partner represented Barr on its sale to Israeli generic drug manufacturer Teva Pharmaceutical Industries Ltd.
for $9.8 billion in cash, stock and assumed debt. The deal was
announced July 18. In 2006 Horowitz handled Barr's $2.5 billion
acquisition of Croatian drugmaker Pliva d.d., a deal in which the
Montvale, N.J., generic drug manufacturer topped a bid from Iceland's Actavis Group hf.
Horowitz landed the client after working across from Barr in
negotiations on a potential deal in 2005 that fell through. He tapped Oded Eran and Adam Klein at Goldfarb, Levy, Eran, Meiri, Tzafrir & Co. as Israeli counsel on the Teva deal.
Barr used
Paul Donofrio,
Matt Miller,
Chris Seiter and
Michael Brocka at
Banc of America Securities LLC the company's longtime banker and its financial adviser on the Pliva transaction.
Teva tapped
Mark Shafir,
Jason Fertig and
Punit Mehta at
Lehman Brothers Inc., where vice chairman
Harvey Krueger
helped begin trading of the Israeli generic drug company's American
Depositary Receipts in the 1980s. Lehman also advised Teva on its $7.4
billion stock and cash acquisition of Miami rival Ivax Corp. in 2005
and its $3.4 billion purchase of Sicor Inc. in 2003.
Willkie Farr & Gallagher LLP's Peter Jakes and Jeffrey Hochman
led Teva's outside legal team. Willkie has worked with Teva since the
1980s and handled the Ivax and Sicor deals. Teva is also using David Hashmall and Frederick Rein of Goodwin Procter LLP on intellectual property and their partner Jonathan Price on products liability; Kirkland & Ellis LLP's Jay Lefkowitz on antitrust and Food and Drug Administration matters; and Menachem Tulchinsky and Yaacov Michlin of Tulchinsky Stern Marciano Ben-Zur Cohen & Co. as Israeli counsel.
